Since the Sunshine State legalized medical cannabis in 2016, more than 656,000 Florida residents see relief from debilitating symptoms from underlying conditions.
Since 2016, the state’s medical cannabis program has expanded to give patients more freedom as to how they choose to consume their cannabis.
In 2019, Governor Ron DeSantis signed SB-182 into law, officially legalizing smokable medical marijuana. SB-182, the Medical Use of Marijuana act, redefines the term “medical use” to include the possession, use and administration of marijuana in a form for smoking.

2022 Florida Statutes outline the most recent guidance for the state’s medical cannabis program. Under these Florida medical marijuana laws, patients may only purchase edibles and other marijuana products that are produced and dispensed by a medical marijuana treatment center (MMTC).

To become a medical marijuana patient in Florida, it’s a three-step process. The state also details that any “medical conditions of the same kind or class as or comparable to those above,” and “a terminal condition diagnosed by a physician other than the qualified physician issuing the physician certification,” qualify patients for certification.
Lastly, a “chronic nonmalignant pain caused by a qualifying medical condition or that originates from a qualifying medical condition and persists beyond the usual course of that qualifying medical condition” is also considered according to the state. Along with having a qualifying medical condition, residents must also meet other state requirements to be eligible for a medical cannabis license.
Patient Possession Limits.
According to Florida state law, a certified physician may not issue a certification for more than three 70-day supply limits of marijuana or more than six 35-day supply limits of raw flower marijuana for smoking or vaping.
Registered patients’ daily THC doses are restricted to 60 mg for edibles; 350 mg for vaporization; 200 mg for capsules and tinctures; 190 mg for sublingual tinctures; 190 mg for suppositories; and 150 mg for topicals.
Lastly, a 35-day supply limit for marijuana for smoking shall not exceed 2.5 ounces.
Caregiver Requirements in Florida.
Like the patient, a caregiver must meet specific requirements by the state to assist a patient with medical cannabis use. A caregiver must prove their address with a valid driver’s license or state identification card, have an email address, and provide a photo.
